Minna – A High court sitting in New Bussa, Borgu Local Government Council of Niger State has ruled against the Niger State Government and the State House of Assembly in the suit filed by the Social Democratic Party (SDP), 14 other registered political parties and five Councillors over the reduction in the tenure of Local Government Council Chairmen in the state.
However, the Niger state government in a swift reaction said it will challenge the New Bussa verdict extending the tenure of Local Government Council chairmen to three years instead of two.
The Court Presided over by Justice Mohammed Mohammed ruled that the Niger State House of Assembly (NSHA) in particular lacked the powers to amend the local government Law 2016 of Niger state published as Niger Legal Notice No.1 as it did to which Governor Abubakar Sani Bello appended his signature and signed into law.
The SDP and 19 others had initially initiated the suit by way of originating summons on the 15th of November, 2017 but amended their process pursuant to an application dated 7th of December which was filed before the court on the 11th December and was deemed amended on the 14th of December last year.
In a 37 page judgment which lasted for about three hours, Justice Mohammed Mohammed held that the failure of the 1st defendant to comply with the constitutional requirements of amending the local government council law 2001 rendered the amended law, ‘unconstitutional, invalid and as well lacking legal status’.
